Terms and Conditions of Use
1. ACCEPTANCE OF TERMS
By registering for an account, accessing, browsing, or using WASTA (“Platform”), operated by SAA Events Incorporated, you agree to be bound by these Terms and Conditions (“Terms”). If you disagree with any part of these Terms, you may not use the Platform.
Updates to Terms:
- WASTA reserves the right to update or modify these Terms at any time without prior notice.
- Continued use of the Platform constitutes acceptance of revised terms. Users will be notified via email, platform announcements, or through prominent notice on the homepage.
2. USER ELIGIBILITY & AGE REQUIREMENTS
- Minimum Age: Users must be at least 13 years old with parental/guardian consent or 18+ to use the Platform independently.
- Account Creation: Users under 13 may not create independent accounts and must seek guardian approval via email or phone verification provided during registration.
- Parental/Guardian Responsibility: Guardians are responsible for monitoring/minor activity and ensuring compliance with Terms.
3. TICKET PURCHASES & SALES
- Ticket Pricing: Prices are set by event organizers and displayed clearly at checkout. Surcharges, processing fees, or service charges are added during purchase unless stated otherwise under event-specific terms.
- Payment Methods: Accepted methods include credit/debit cards, digital wallets, and other third-party processors integrated into the Platform.
- Delivery Methods:
- Digital tickets: Emailed immediately post-purchase and accessible via the user account.
- Physical tickets: Mailed to the address provided during checkout (shipping fees apply).
- Transfers/Resales:
- Unauthorized resale/scalping is prohibited without prior approval from WASTA and/or event organizers.
- Tickets are non-transferrable unless explicitly permitted in event-specific terms (e.g., corporate events).
4. REFUND AND CANCELLATION POLICY
- No-Refund Policy: All ticket sales are final unless explicitly stated in event-specific terms (see Section 5).
- Exceptions:
- If the event organizer cancels the event pre-dated, refunds will be processed minus processing fees (up to [3]%).
- Partial refunds may apply for rescheduled events subject to organizer discretion (communicated via email).
- Processing Fees: Non-refundable fees cover payment gateway charges (e.g., chargeback costs) and service fulfillment expenses.
- Timeline: Refund requests must be submitted within [10] days of event cancellation or rescheduling via email (no exceptions).
5. EVENT-SPECIFIC TERMS
- Event Organizer Responsibilities: Organizers must ensure compliance with venue rules, local laws (e.g., fire safety), and health requirements.
- Venue Rules: Users must adhere to venue-specific guidelines (e.g., dress codes, capacity limits) communicated during checkout or pre-event emails.
- Age Restrictions: Users must verify age requirements listed per event (e.g., “19+ only”) during checkout using ID verification tools (see Section 8).
6. USER CONDUCT
- Prohibited Activities:
- Fraudulent behavior (e.g., fake accounts, unauthorized payments).
- Resale of tickets via third-party platforms without WASTA approval.
- Abuse of customer support systems
- Consequences: Violations may result in permanent account suspension, and legal action.
- Fraud Prevention: WASTA employs automated systems and manual reviews to flag suspicious activity.
7. LIABILITY AND DISCLAIMERS
- Platform Liability: WASTA is an intermediary and not liable for event cancellations, poor service quality, or third-party claims (see Sections 1–6).
- Event Organizer vs. Platform: Organizers are solely responsible for health/safety incidents. WASTA assumes no liability beyond Platform functionality failures.
- Force Majeure: WASTA will not be liable for disruptions caused by natural disasters, government actions, or cybersecurity breaches beyond its control.
- User Assumption of Risk: Users acknowledge risks inherent in attending events, and agree not to hold WAST, organizers, venue providers accountable post-purchase.
8. INTELLECTUAL PROPERTY
- Platform Content: All Platform content is owned by WASTA and protected under copyright/trademark law (*Canadian Trade-marks Act (R.S.C., 1985, c. T‑13)).
- User-Generated Content: Users retain ownership of content posted publicly but grant WASTA perpetual rights to use, modify, or display such content royalty-free globally.
- Trademark/Tradition Protection: Unauthorized use of Platform trademarks, trade secrets , or branding constitutes infringement punishable per local laws.
9. PRIVACY AND DATA
- Refer to WASTA’s Privacy Policy for details on data collection and sharing practices.
- Data collected includes personal info (*name, email or phone number *) for ticket fulfillment and analytics (e.g., user behavior trends).
- Third-party integrations comply with GDPR and CCPA guidelines.
10. DISPUTE RESOLUTION
- Governing Law: These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein.
- Arbitration Clause: Disputes must be resolved via binding arbitration through ICDR Canada per their rules.
